As of 1 September 2026, Sections 72/B and 74/D of the Academic Regulations (HKR) have been amended. Section 377/A of the Faculty-Specific Provisions remains in force without any changes.
ARS section 72/B
(3) The student is prohibited from using earphones or headphones during the online oral examination. The instructor should make sure, if possible, that the student is taking the exam alone without anybody else present in the room. In the event of a breach of this rule, the provisions laid out in Section 74/D shall apply. Exceptions to this rule are registered students with special needs if they are hindered in oral communication or in the technical execution of the exam (computer use or handling of online interfaces). In their case, the presence of a personal helper, note-taker, captioner, sign or oral interpreter shall be permitted. In this case, the camera must be set up in a way so that both the student and their helper are visible.
ARS section 74/D
(1)The integrity of the assessment is violated if the student uses or has in their immediate possession an unauthorised device, utilises unauthorised assistance or information sources during the assessment, does not rely exclusively on their own knowledge, preparation, and independent work, or participates in the assessment on behalf of another person. The instructor shall specify the permitted devices for use during the assessment in the course syllabus.
(2) In the event that the student violates the integrity of any form of evaluation relating to the course, the lecturer or any individual contributing to the procedure of the evaluation shall have the right to stop the evaluation and
a) the lecturer shall have the right to give the student in question a failing grade or
b) initiate disciplinary proceedings.
(3) In disciplinary proceedings initiated due to a breach of assessment integrity,
a) if the student commits the offence alone and it is only capable of affecting their own result, the following consequences shall apply:
aa) for the first offence: a reprimand and the declaration of the assessment as void; if the student admits the offence in writing or by electronic means, the disciplinary committee may issue a disciplinary decision without an evidentiary procedure or hearing;
ab) for the second offence: suspension from studies for a specified period – not exceeding one semester – and the declaration of the assessment as void;
ac) for the third offence: expulsion from the programme and the declaration of the assessment as void.
b) the disciplinary committee may, within the framework set out in Nftv., exercise discretion in its decision if:
ba) the student committed the offence jointly with another person, or
bb) the act is capable of affecting another student’s result or undermining the order of the assessment, or
bc) the act was carried out through abuse involving IT or electronic devices, or
bd) the student’s offence under paragraph (1) is adjudicated in the same procedure as their conduct under Section 169 (1). If the disciplinary committee establishes a breach of assessment integrity under points ba)-bd), it shall also declare the assessment as void.
(4) If disciplinary proceedings are initiated under paragraph (2), the assessment shall be considered void until a final and binding decision is reached.
(5) The provisions of paragraph (3) shall be interpreted such that the statement of a single person is not, as a rule, sufficient to establish disciplinary liability.
ARS section 377/A
(1) A student who uses aids other than those specified by the instructor or provides unauthorised assistance to another student during an evaluation (exam, test, homework assignment) requiring the preparation of a computer programme or programme module is in violation of the academic rules, and shall not be permitted to complete the subject in the given semester and therefore shall not obtain the credit awarded for the subject.
(2) A minutes shall be taken of the violation referred to in paragraph (1), which shall include the place, time, and a brief description of the circumstances of the violation, as well as a statement by the student in question declaring whether they admit to or dispute the allegation against them. If the student disputes the allegation against them, the Dean shall conduct a hearing to clarify the facts.
